Represented the owner of a vacant tract of land with development entitlements in place to build housing on the subject property prior to Lee County’s acquisition of 3.4 acres for the Estero Parkway project. During the due diligence period, Lee County effectively negated existing permits and other rights owner was entitled to for the development. Owners asked for relief from the frustration caused by the government’s thwarting of owners’ reasonable investment-backed expectations for the subject property. A valuation jury trial was subsequently held and owners prevailed with a verdict compensating them for part taken and severance damages.
